Erben-Ermittlung Emrich
WE’RE GLAD WE FOUND YOUYou likely did not happen upon our website by accident; being contacted by a probate research company is not an everyday occurrence.
You probably have several questions: who are we, what do we do and what is your role as a potential heir.
The majority of cases we handle are estate matters in which the decedent has passed away without leaving behind a last will or testament. In such cases, the legal succession comes into play, as German inheritance law dictates that every inheritance is in possession of heirs. If there are no living spouses, descendants, siblings or parents – the courts, custodians of the estate, and/or individual heirs often exhaust their possibilities in determining the community of heirs. At this point, the work of professional probate researchers begins, and the search for the rightful heirs continues. Research often traces back to the 19th century and, due to migration, war, flight and expulsion, it can lead all over the world. Additionally, the complexity of family structures today, the increase of divorce and remarriage rates at every age, and mobility, which has increased over the past decades, mean that the decedent and/or the family connections are often unknown to the newly uncovered heirs.

WHATEVER YOUR PERSONAL FAMILY HISTORY MAY BE:
YOU HAVE BEEN SOUGHT OUT AND WE WERE SUCCESSFULLY ABLE TO LOCATE YOU.
OUR SERVICES: HOW WE SUPPORT YOU
We support you during the various formalities necessary for the final disbursement of your share to the inheritance.
The crucial, initial steps have already taken place. Professionally and earnestly.
OUR FEE
We work on the basis of a contingency fee, which is calculated in accordance with the scope and effort of our research.
Unless otherwise agreed, the fee, plus the statutory value-added tax (VAT), will cover all past and future costs along with fees incurred for establishing your claim to the estate; this includes all legal, accounting, and notary fees.
The agreed contingency fee is only paid if and when your share of the inheritance is disbursed to you. Furthermore, the fee is recognized by the tax authorities as debts accrued to the heir, thus reducing the inheritance tax.
HERE FOR YOU: OUR TEAM
OUR RESEARCH TEAM
THE HEART OF OUR COMPANY.
The research team works closely with our international department to efficiently and resolutely investigate both German and foreign inheritance matters. We employ all available online resources, archives, and an international network of correspondents to reliably locate heirs.
Nicholas Lang
Head of the Research Department
OUR DOCUMENTATION TEAM
IN SERVICE OF EVIDENCE.
The task of the documentation department is to prove the lineage of the heirs we identified. To do so, they acquire all necessary vital records from the relevant authorities, archives, and courts. If any given document has not survived the past decades (or even centuries), or if the family tree extends to a period before vital records were officially maintained, our team of experts will find alternative proof to document your claim to the estate.
Christian Pförtner
Head of Documentation Department
OUR CERTIFICATE OF INHERITANCE TEAM
LEGALLY COMPETENT.
The certificate of inheritance department verifies all collected documentation and prepares the certificate of inheritance authorization by a notary public. The process is consistently monitored in cooperation with our attorneys until the certificate of inheritance is issued by the probate court. Our team works closely together with and under the guidance of our legal department.
Holger Ludloff
Head of the Certificate of Inheritance Department
OUR ESTATE SETTLEMENT TEAM
CAREFUL AND EFFICIENT.
Once the certificate of inheritance has been issued, it is the job of the estate settlement department to collect the inheritance and distribute it to the heirs. Their work includes, among other things, closing the decedent’s accounts, preparing the inheritance tax application with our accountant, valuing and liquidating assets and real estate, and cooperating with attorneys and notaries in preparation of the estate settlement.
Manuela Schmidt
Head of the Estate Settlement Department
OUR INTERNATIONAL DEPARTMENT
CONNECTED WORLDWIDE.
The international department supports the research team when the investigation of an estate matter leads abroad. The international department supervises inheritance proceedings abroad, establishes contact with foreign correspondents, and coordinates cooperation with our foreign branches and partners. In addition, they support the documentation team when vital records and other documents, necessary for the German certificate of inheritance application, are located abroad.
Claudia Häßler
Head of the International Department
YOUR QUESTIONS, OUR ANSWERS
HOW DO WE RECEIVE THE ASSIGNMENT TO LOOK FOR AN HEIR?
Either we are assigned by the probate court, the estate administrator or an heir, – or we begin research of our own initiative.
TO WHOM DID THE ESTATE BELONG?
Typically, the decedent is a relative who passed away without leaving behind a will or last testament. As stipulated by the German law of inheritance, the heir need not be a close relative of the decedent. In many cases, the heir presumptive did not personally know the decedent.
IS IT POSSIBLE TO INHERIT DEBTS?
It is in our own best interest to assess the value of an estate before we begin our investigations. We do not handle insolvent estates.
IS IT POSSIBLE TO MAKE AN APPOINTMENT TO DISCUSS THE ESTATE MATTER IN PERSON?
We welcome you to visit our office in Berlin, or any of our branches located throughout Germany. If a member of our team is located near you, they can arrange a visit to or near your home. Please, do not hesitate to contact us to inquire about a face-to-face meeting.
WHAT HAPPENS IF I AM NOT ELIGIBLE TO INHERIT AFTER ALL?
If at any time during the probate process it is determined that you are not eligible to inherit, you will have no financial obligations whatsoever. As you are no longer to receive a share of the estate, we are not entitled to receive the sum of the fee.
DO I HAVE TO MAKE PAYMENTS IN ADVANCE?
No. We assume all risk and work on your behalf without receiving any payments in advance.
WHO IS ENTITLED TO INHERIT?

HOW DOES THE INHERITANCE TAX AFFECT ME?

INFORMATION ON INHERITANCE LAW
In Germany, inheritance law is firmly anchored as a fundamental right in the constitution (Grundgesetz, GG).
This includes the option to freely decide who will be considered in a last will after death – even outside the legal succession.
If a last will does not exist, the rules of legal succession take effect. These rules are regulated in Germany in §§ 1922 ff. of the German Civil Code (BGB). To determine the degree of kinship between the heirs and the decedent, various orders of inheritance are used. The relationship can be very remote. If, for example, the so-called 4th order of inheritance comes into effect, it is quite possible that the heirs do not even know the person from whom they are entitled to inherit.
Outside of Germany, other inheritance laws may apply that, for instance, may exclude higher orders of inheritance. In the USA, for example, inheritance law is determined by state, not federal, regulations.
Our team of attorneys and genealogists is equipped to handle such highly complex issues.
